Terms & Conditions of Service – WintageClub
This website wintageclub.com and wintageclub.it is operated by Digital Brain SRL (VAT IT10597551216, Via Francesco Caracciolo 10, 80122 Naples, Italy), an Innovative Start-Up under Italian law, trading as WintageClub.
1. Acceptance of terms
By visiting our sites and purchasing our products, you accept these Terms & Conditions. We reserve the right to update them at any time. The current version is always available on this page.
2. Products and prices
All products are second-hand and vintage clothing, each unique. Prices include Italian VAT where applicable. Prices may change without prior notice. We reserve the right to cancel any order containing an obvious pricing error.
3. KiloBox — assembled to order
Our KiloBox bundles are assembled to order based on your chosen parameters (type, weight, grade). As made-to-order products with variable, non-standardised composition, the 14-day right of withdrawal does not apply under art. 59(1)(c) of Italian Legislative Decree 206/2005 (Consumer Code). You expressly accept this exclusion at checkout.
4. Order process
After placing an order, you receive a confirmation email. This constitutes acceptance of your order by WintageClub. We reserve the right to decline or cancel orders in cases of stock unavailability, payment failure or suspected fraud.
5. Payments
We accept major credit/debit cards, PayPal, Apple Pay, Google Pay and other methods displayed at checkout (powered by Stripe and Shopify Payments). All transactions are processed on secure, encrypted servers. Card data is never stored by WintageClub.
6. Shipping and delivery
We ship across Italy and the EU. Delivery times are indicative: 2–4 working days for Italy, 3–8 working days for other EU destinations. We are not liable for delays caused by carriers, customs or force majeure events.
7. Legal guarantee of conformity
The 24-month legal guarantee of conformity under Italian Legislative Decree 206/2005, arts. 128–135 (Consumer Code) applies to all products, taking into account their second-hand nature.
8. Intellectual property
All content on this site (text, images, logos, graphics) is owned by Digital Brain SRL and protected by Italian and EU intellectual property law. Any reproduction without written authorisation is prohibited. WintageClub and KiloBox are trademarks of Digital Brain SRL.
9. Limitation of liability
WintageClub is not liable for indirect, incidental or consequential damages arising from the use of our products or services, within the limits permitted by applicable law.
10. Governing law and dispute resolution
These Terms are governed by Italian law. For consumer disputes, the competent court is that of the consumer's place of residence. Consumers can use the EU ODR platform: ec.europa.eu/consumers/odr.
